1.1. These Website Terms of Use (the “Terms”) set out the rules for using barvaclothes.com and its English version barvaclothes.com/en (the “website”), the online store of Barva Kimono (“Barva”, “we”).
1.2. The owner of the website and the seller is the individual entrepreneur (FOP) Ovcharenko Anastasiia Vasylivna, RNOKPP (taxpayer number) 3268806706, registered address: 41 Mashynobudivna St., Kyiv. Contact details are given in section 11.
1.3. By opening and using the website, you agree to these Terms. If you do not agree with them, please do not use the website.
1.4. These Terms cover the use of the website. The purchase of goods and gift certificates is governed by the “Public Offer”, delivery and payment by the “Delivery and Payment” page, exchanges and returns by the “Exchange and Returns” page, and the processing of personal data by the “Privacy Policy”. In matters of sale and purchase, the “Public Offer” prevails in case of any inconsistency.
2.1. Anyone may browse the website free of charge and without registration. The website has no customer accounts.
2.2. Orders may be placed by persons aged 18 or over with full legal capacity. Minors aged 14 to 18 may place orders within the limits allowed by Article 32 of the Civil Code of Ukraine or with the consent of their parents (legal guardians). For children under 14, orders are placed by their parents or other legal guardians.
2.3. The website is intended for personal, non-commercial use. For wholesale purchases, collaborations or use of our materials, please write to us.
3.1. Our kimonos, suits and trousers are sewn and dyed by hand in our Kyiv workshop. Because they are hand-dyed, each item is unique: the pattern, shade, colour intensity and dye marks may differ from the photos and from other items of the same model. This is a natural feature of handmade work, not a defect.
3.2. Colours on screen depend on your device settings and the lighting during the photo shoot, so they may differ slightly from the real ones.
3.3. Because the items are sewn by hand, their actual measurements may differ slightly from those stated on the website. If you are unsure about the size or colour, write to us before ordering: we will help you choose and, where possible, send additional photos.
3.4. We prepare product descriptions and photos with care. The terms of sale, including product characteristics, are set by the “Public Offer” and the confirmation of your order.
4.1. Prices on the website are stated in Ukrainian hryvnias. Prices in US dollars are shown for convenience and are for reference only: payment is made in hryvnias. The bank that issued your card may apply its own conversion rate and fees.
4.2. We may change prices and the product range without prior notice. The price of an order is fixed at the moment the order is placed and does not change afterwards.
4.3. Many items are made in small batches or as one-offs, so availability on the website may update with a delay. If an item turns out to be unavailable after you have ordered it, we will contact you and offer another item, making it to order or a refund, in accordance with the “Public Offer”.
4.4. If an obvious technical error occurs in a price or description, we will let you know before dispatch: you will be able to confirm the order on the correct terms or cancel it with a full refund of all amounts paid.
4.5. The terms of use of gift certificates are set by the “Public Offer” and the certificate description on the website.
5.1. All materials on the website, including photographs, texts, product descriptions, videos, graphics, the design of the website and its elements, and the Barva name and logo, belong to FOP Ovcharenko Anastasiia Vasylivna or are used with the permission of their authors. They are protected by the Law of Ukraine “On Copyright and Related Rights” and the Civil Code of Ukraine. Copyright arises when a work is created and does not require registration.
5.2. Copying, distributing, publishing on other websites, marketplaces or social media, modifying our materials or using them in advertising or to sell goods is allowed only with our prior written permission. An email from us is sufficient.
5.3. Without separate permission, you may:
5.4. Using our photos or texts to sell other goods, including copies of our items, infringes our rights. In that case, we will protect them by the means provided by law, including complaints to platforms and court proceedings.
5.5. Please do not use the Barva name and logo without our consent in a way that suggests you are connected with us or endorsed by us.
5.6. Photos of our items that you take yourself belong to you. We will be glad if you tag @barva_kimono.

8.1. We make every effort to keep the website running smoothly and the information on it accurate, but we cannot guarantee uninterrupted, error-free operation. The website may be temporarily unavailable due to maintenance, failures of hosting, internet providers, payment or postal services, power outages or other circumstances related to martial law.
8.2. To the extent permitted by law, we are not liable for:
8.3. Nothing in these Terms limits the rights you have as a consumer under the laws of Ukraine or excludes our liability where the law does not allow it to be limited. Our liability for the goods sold is determined by the “Public Offer” and consumer protection legislation.

9.2. If a problem arises, please write to us and we will try to resolve it through negotiation.
