We want your Barva piece to fit and bring you joy. If something has gone wrong, write to us and we will find a solution together. These terms comply with the Law of Ukraine “On Consumer Rights Protection” and form part of the “Public offer”.
1.1. You can exchange an item of proper quality for another size or model, or return it and get your money back, within 14 days of receipt (the day of receipt is not counted). You do not have to give a reason.
1.2. An exchange or return is possible if:
1.3. You may try the item on to check the size and fit; this does not count as use.
1.4. Kimonos, suits, trousers, tops and bombers are not on the List of non-food goods of proper quality that cannot be exchanged or returned (Resolution of the Cabinet of Ministers of Ukraine No. 172 of 19 March 1994).
1.5. We sew every piece after it is ordered, so an exchange for another size or model means sewing a new item, which will be made within the time stated on the product page. If the new item costs more or less, we will agree on an additional payment with you or refund the difference.
2.1. Items sewn to your individual parameters, for example with the length adjusted to your height or with other changes made at your request. Such an item of proper quality cannot be exchanged or returned: the law does not grant the right to withdraw from a distance contract if the contract concerns goods made to the consumer’s order, that is, goods that cannot be sold to other persons or can only be sold with significant financial loss to the seller (item 3 of part 5 of Article 13 of the Law of Ukraine “On Consumer Rights Protection”). We agree on individual parameters with you before sewing begins.
2.2. Items that show signs of use, were damaged after receipt or no longer have their labels.
2.3. Items received more than 14 days ago (except where the item is defective; see Section 3).
2.4. Gift certificates are subject to separate rules; see Section 7.
2.5. These restrictions apply only to goods of proper quality. If an item is defective, you have all the rights described in Section 3, including for items with individual parameters.
3.1. If you find a manufacturing defect (for example, a faulty seam, fabric or fastenings) or have received a different item or size from the one you ordered, write to us and attach photos.
3.2. Under Article 8 of the Law of Ukraine “On Consumer Rights Protection”, you may demand:
3.3. If the defect is significant and caused by the manufacturer, you may, at your choice, demand a replacement with the same or a similar item, or termination of the contract and a refund of the amount paid.
3.4. Claims regarding defects may be made within the warranty period or, if no warranty period has been set, if the defect is discovered within two years of receiving the item (part 2 of Article 680 of the Civil Code of Ukraine).
3.5. If a quality check is needed, we carry it out within 14 days; you may take part in it in person or through a representative.
3.6. The following are not defects:
6.1. We refund the money to the card used for payment via the Plata by mono payment service, in hryvnias, in the amount paid for the item.
6.2. The refund is made on the day we receive the returned item or, if that is not possible, no later than within 7 days (part 3 of Article 9 of the Law of Ukraine “On Consumer Rights Protection”). If the contract is terminated because the item is defective, the money is refunded within the same period from the day the contract is terminated (part 7 of Article 8 of that Law).
6.3. The time it takes for the money to reach your card depends on the bank that issued it. If your card is in a different currency, the amount after conversion may differ because of your bank’s exchange rate.
6.4. The delivery fee you paid to the carrier when receiving your order is not refunded, as the delivery service has already been provided. The exception is the return of a defective item or an item sent by mistake: in that case we also reimburse these documented costs.
6.5. If an order was paid with a gift certificate, the amount paid with the certificate is returned to the certificate, and the amount paid by card is returned to the card.
7.1. Certificates are available with a face value from 2,000 to 10,000 UAH. They can be used to pay for goods on the website up to the face value.
7.2. A certificate is valid for 1 year from the date of purchase.
7.3. A certificate cannot be exchanged for cash, either in full or in part, except in cases provided for by law.
7.4. If the order total exceeds the face value, you pay the difference online. [If the order total is less than the face value, the remaining balance stays on the certificate until it expires.]
7.5. If a certificate has not yet been used, you may withdraw from its purchase within 14 days of payment and get your money back to the card used to pay for it.
7.6. Items paid for with a certificate are exchanged and returned on the general terms described on this page.
